I feel your pain

The really sad thing to me about this story is that in 31 states, the age of consent is 16 years of age (see “http://www.age-of-consent.info”). In New York it happens to be 17 years of age, probably because when the idiot politicians over there created their age of consent law, the dart they threw happened to stick in spot “17″ on the dart board.Submitted on 2013/01/30 at 3:47 am

notamonster, you should definitely look into a remedy known generally as the “Certificate of Rehabilitation”; at least, that’s what it’s called here in California. In New York there are actually 2 different versions; the “Certificate of Relief from Disabilities” and the “Certificate of Good Conduct”. I’m not going to attempt to explain both of these in this post, but you can read all about them here: “http://lac.org/toolkits/certificates/summary_state_laws.htm”. Scroll down to the bottom of that page and you’ll find New York, plus a link to more information for that state.

The way it works in California is, IF you are allowed to apply for the COR at all (certain sex offenses here in Cali are ineligible for this relief, like mine unfortunately), and of course, IF the judge decides to grant the request, you are removed from the public internet registry and are relieved of any further responsibility to register as a sex offender. I have not done any research on New York, but a search for the word “sex” in the few documents I did glance at just now came up blank; this could be a good thing, or it could be bad. Bottom line is, you should definitely look into this relief, and if you need help with that let me know and I will dig up what I can.

I’ll be the first to tell you or anyone else that common sense is dead in this country, and in most of the world for that matter; BUT, based on what I’ve read in your story above, it seems to me that your “crime” is likely one of the LEAST serious of the sex offenses. Again, I don’t know all of the details OR the applicable New York laws, but you say you were “in a relationship” (sounds consensual), and the young lady was just one year below NY’s age of consent. If you were in that situation in California, you would DEFINITELY be eligible!

Anyway bro, I feel your pain man, I really do. And, I hope I’m not getting your hopes up for no reason, but I’ve got to believe that you’ve got a shot at real legal relief given your circumstances.   1. hubs on probation 14 more years out of 18 yrs he plead to , then never heard of sex offender registry in my life and were told in order get the plea he would have to register 🙁 ughh so now 14 more years probation . and rest his life on registry . it make me ill and so sad i dont know what to do . all i can do is pray and beg GOD to do something to stop all this stuff. we want to be normal again .; do what normal people do.. asked probation about going somewhere like a lil couple day vacation . first they say yes then calls tells us talk to councellor then probation calls says i dont think it would be god idea and my husband was mad. we wanted to go look at the beautiful scenery and enjoy the fresh air . together as family . , councelor said i can take my son to another area etc ,and i told my husband i wouldnt do that cause we are family if he cant go i dont either . i feel his pain
    🙁 every day , seeing his circulation get almost cut off from ankle bracelet . see how he cant go now where and do nothing breaks my heart. so instead going thru our plan hes not allowed :(now. im tired of it!!!these laws have to be done away with to be casted out nomore to return in JESUS name . we want some freedom while we are living . not be imprisoned rest of our lives. cant enjoy fresh air no park cant go on sky lift cause supposedly by park ,, ur in the air people . your with family . trying to enjoy GOD creation .i just want JESUS to come get us out of this dung hole we are living in . or change the unconstitutional laws. i wrote aclu . i hope they even read my letter .my son needs his father to be able to participate be part the family and be able to do normal things in life .and he cant even have that::(

  2. I WAS ARRESTED FOR SEXUAL-BATTERY ON 12-29-2002. I WENT TO PRISON AT BAY COUNTY CORRECTIONAL FACILITY IN PANAMA CITY, FLORIDA, AND SPENT 26 MONTHS OF A 30 MONTH SENTENCE. I GOT OUT 2-11-2005, ARRIVED IN NASHVILLE, TENNESSEE ON 2-12-2005, HAVE BEEN REGISTERED AS A SEX OFFENDER SINCE FEBRUARY OF 2005 AND HAVE NOT BEEN IN ANY KIND OF TROUBLE, LEGAL OR OTHERWISE. IT IS NOW 4-7-2013; WHEN, IF EVER, CAN/WILL I GET TAKEN OFF THE SEX OFFENDER REGISTRY?!. HOW LONG MUST I/WE SUFFER/PAY FOR MY/OUR CRIME? THANK YOU FOR YOUR TIME AND TROUBLE.

    1. I hear ya Ken; it’s a vicious cycle they have gotten us snagged in. I went to prison 1995 and did 8 years of a 9 year ticket because the judge said he was going to make a example of me.
      And haven’t been in trouble since, and was due to come off the registry in 2014.
      But now am on for life all because of being convicted of 5 charges child porn on the internet.
      I just wanted to do my requirements and get off the registry and then live out the rest of my life in peace and quiet.
      Since, I have nothing left–NO family (at least none that will talk to me) and what friends I do have are fine. I will live out my life knowing I screwed up, and now there’s no hope at finding any love for me now. That’s fine; maybe it’s part of my punishment.
      I don’t know but it’s a reality, there’s not many women out there that can look past a person’s conviction of any type of sexual crime.
      So keep your chin up Ken, as it gets better, maybe not in all things we want.
      I’ve been lucky; I have a home and hardly anyone bothers me, EXCEPT now since the new law came out, my mailbox has been smashed 2 times. LOL
