Private Attorney General

By James Coghill I’m a paralegal not a lawyer. What I am about to write should not be construed in any way as legal advice and this information is provided for your education only, freely given without charge. What you do with this knowledge is entirely up to you. To get into court as a normal citizen and raise a claim you must have a legal standing to be there and you must prove it to the court. This works to prevent frivolous claims. Otherwise you must hire a lawyer which then gains you admission to the club. The lawyer then serves as a filter for frivolous cases. What most people don’t know is what is contained in Civil Rights Act of 1866 which makes every citizen a Private Attorney General. This was something new to me. After 15 years of working with the law I had never seen this before which is why I present this info here. Even…

Entry Denied – International Travel

By Ron… 20 years ago I plead no contest in a case of the on line undercover police seeking predators. I never touched, met, or did anything to anyone. Back in 1998, things were different. I was never put in jail or prison, I served 2 1/2 years of probation, I was not required to attend sex offender classes, or submit and blood samples to the state of Florida, There were only a few conditions placed on me, and the judge wanted me not to be part of the registry, but he had no choice since the Cop was pretending to be 14 years old. We all make mistakes in our lives, but I never thought how much my life changed. I have traveled in the past and had no problems until I arrived back in Florida. This August, I was planning to engaged to my Fiance in Colombia. I registered as by law of my trip in advance, I…

When running into a juror who wrongly convicted me.

By: Timothy Lawver I thought I’d post this story from my town. https://www.channel3000.com/news/crime/retired-police-officer-accused-in-child-sexual-assault-federally-indicted-wednesday/784893067 I ran into this cop on many occasions, but one in particular I’d like to share. Immediately after I was released I set about contacting groups about my wrongful conviction. I contacted several lawyers, called and wrote the innocence project, and hit the public library. I enter our public library and at the information desk I made eye contact with a man who had looking down messing with books. When he looked up we both recognized one another immediately. He had been a member of the jury who convicted me wrongly. Both stunned almost not wanting to engage at all. It was incredibly awkward. I gathered myself and asked him where the law books were? He got a funny look that turned into disgust and said nothing but pointed toward the section I was looking for. I dug around looking for case law for about an hour,…

Five Years of Hell

Hello, my name is Michael and in July of 2015 I was sentenced in Pennsylvania on one charge of invasion of privacy. In August of 2013 I was accused of using an old cell phone to “sneak a peek” at a girls behind in my bathroom at my home. I was sentenced in 2015. My cousins were there that night and not even involved, but pressed charges on me. My one cousin had just become a deputy sheriff in the County Court house and her Boyfriend had just become a part time police officer. They used scare tactics to get me to confess to this crime and even frisked me days later illegally. They told me if I didn’t tell them what they wanted to hear and if I didn’t give them my cell phone, they would go to the police. I was later brought to the court in which my cousin (whom of which pressed the charges) works and…

What I Did On My Summer Vacation – I Got Deported

By James…. My parents, who are in their 90’s and in need of assistance when they travel wanted me to go with them to their time-share in Cabo San Lucas, Mexico. Initially I wasn’t thrilled with the idea because I am an RSO and every time you travel you can easily run afoul of the law and wind up back in prison by doing nothing. We have all experienced that if you have done nothing wrong the government will invent something, we know the name of that tune. Since my ultimate goal was to leave the country and never return after my parents pass away I decided that this would be a good dry run for doing that. That way if something unexpected happened I could fix it when the time came to leave for good. Having heard horror stories from inmates who had problems with the Arizona Department of Public Services (ADPS) who told them to do one thing…

Engaged and Enraged

My fiance is my favorite person, ever. It kinda makes sense, as I’m preparing to marry him. But how and when we got engaged was less than desired. Backing up a bit, I love this dude. We fell in love the moment we met over 3 1/2 years ago. He is incredibly ambitious and compassionate. Having working in fields where he saved people’s lives, put out burning buildings, and performed cpr on kitties… and he’s a gentleman. I came from a background of sexual trauma and was healing, and he was there supporting me throughout everything. He saw firsthand the impact it can have. We went through tough times (financial troubles) and broke up occasionally, always coming back together. During one brief break up, he went on a date with a girl (we were still talking) and thought it went well. 3 hours later the girl texts him saying she felt uncomfortable during their date, so he apologized. 3 days…

Hired as Felon, Fired Because of the Registry

By: TK…. My employment was discharged yesterday. The circumstances around my discharge are such farce, that I feel compelled to share. I am 31 years old today, I plead no contest to an attempted sexual assault 9 years ago. I was 22, and the plaintiff was 19 at the time. Ultimately, I spent 2+ years in prison, released in 2012. For 3 years I worked for my family in the midwest. I moved to Florida to be near my partner’s family in 2015. I have scraped by with odd jobs and I have been loosely involved in criminal justice reform efforts these past 3 years. For the past 7 months, I have worked with a local Reentry Coalition. 3 months ago, the coalition director and I met with the director of our local reemployment offices. One month ago, the director of reemployment suggested that I apply to work there, she said that she was about to launch a reentry program…

Quotes, Sources and Thoughts

“Sex abuse is a ‘growth industry.’” –in “The ‘Validators’ and other examiners” in Issues in Child Abuse Allegations in 1991 by Richard A. Gardner—found in Manufacturing Victims: What the Psychology Industry is Doing to People by Dr. Tana Dineen. Dineen’s 1996 book is heavy reading but has scads of very interesting, very relevant quotations with details of sources. (A list of the more interesting pages is added below. A pdf of Gardner’s full article is online.) Gardner has some very vocal critics, and he does say things even I find questionable. However, I imagine his critics can’t even begin to deal with his first irrefutable point: counseling ‘professionals’ who call themselves “validators” of abuse reveal a telling bias and prejudice about themselves. Having skimmed the article and some of his other work myself, I’d bet those critics cannot even begin to respond to some of the other things he says in an effort to improve how evaluations of allegations are…

Prison

By Jim…After I was separated from my family and taken away from the courtroom I was placed in a holding cell. The cell actually had bars and was a carryover from the 60s when the courthouse was built. There I was stripped out and given an orange jumpsuit to wear. I was asked if I was suicidal and I replied, “I was given a life sentence what do you think?” Then I was transported in a van that was packed to the point where there was no room for any other people. Once I arrived at the jail I was booked, fingerprinted and processed by a medical. During my medical processing it was discovered that my blood pressure was 188/132 and I was immediately placed on high blood pressure medicine. After that I was placed on suicide watch where my clothes were taken away from me and I was given a suicide vest held together with Velcro to wear instead….
